Mineral Resources Act 1989 - Forms
The Mineral Resources Act 1989 provides the framework for accessing land to explore and develop mineral resources in Queensland.
Mining Districts
Changes to the Local Government Act 2003, by the Local Government Reform Implementation Act 2007 (assented to on 10 August 2007), has necessitated consequential amendments to the Mineral Resources Regulation 2003 to change how mining district boundaries are described. These legislative changes commenced on 15 March 2008.
The Mines and Energy Legislation Amendment Regulation (No. 1) 2008, made by the Governor in Council on 13 March 2008 and published in the Queensland Government Gazette on 14 March 2008, amended the Mineral Resources Regulation 2003. Among other things, these amendments changed how mining district boundaries are described.
The Mineral Resources Regulation 2003 now describes mining district boundaries with reference to various maps. These maps may be inspected, free of charge, during office hours on business days at the department's office at Level 2, 41 George Street, Brisbane and at any district office. The maps may also be viewed here.
Register
The Department of Mines and Energy is required to facilitate and regulate the carrying out of responsible mining activities and the development of a safe, efficient and viable mining industry in Queensland under the Mineral Resources Act 1989 (the Act).
The Department maintains a Register under section 387 of the Act. This register contains information collected from a variety of sources, including application forms submitted under the Act. The particulars to be recorded in the register are prescribed in Part 11 of the Mineral Resources Regulation 2003 (the Regulations).
Under section 68 of the Regulations, the public can inspect the Register between the hours of 8.30 am and 4.30 pm on business days, and anyone may take extracts from the Register and acquire, upon payment of the prescribed fee, a copy of all or part of a notice, document or information held in the register. Information contained in the Register includes (but is not limited to):
- the mining tenement number;
- the full name of the holder/s of the mining tenement;
- the annual rent for the mining tenement; and
- any permitted dealings relating to the mining tenement that are approved by the Minister.
Privacy
In accordance with the Information Privacy Act 2009, information collected in the Register may be provided to other Queensland Government Agencies, where such disclosure is necessary for the effective management of the mineral resources and industry in Queensland. These agencies may include the Department of Environment and Resource Management.
Where information provided is commercial in confidence, it will be treated as confidential and not included in the Register or be disclosed outside the agency unless the Department is legally required to do so.
