Petroleum & Gas Act 2004

The Petroleum and Gas (Production and Safety) Bill 2004 (P&G Bill) was introduced into Parliament on 12 May 2004. A set of explanatory notes to the Petroleum and Gas (Production and Safety) Bill 2004 (P&G Bill) is available.

Originally it was intended that the P&G Bill would replace the Petroleum Act 1923 and all existing petroleum tenures, pipeline licences and refinery permissions under the Petroleum Act 1923 would be "transitioned" to become equivalent tenures and licences under the P&G Bill.

However, implications of the Native Title Act 1993 (Cwlth) are such that authorised activities on many existing petroleum tenures may have been affected until native title issues were addressed. Therefore, tenures that are likely to be affected by native title are to continue under the Petroleum Act 1923, rather than being transitioned to the P&G Bill. Accordingly, the Petroleum Act 1923 is to be amended to incorporate, to the extent possible, relevant provisions of the P&G Bill.

The Petroleum and Other Legislation Amendment Bill 2004 (POLA Bill) provides for the amendment of the Petroleum Act 1923 and the transitional provisions for the existing petroleum tenures, pipeline licences and refinery permissions to be administered under the P&G Bill.
