Rents on mining and petroleum tenements
Rents are levied at different rates and are payable annually on all exploration, mining and petroleum tenements held.
With respect to mining leases (MLs), mining claims (MCs), mineral development licences (MDLs), and all petroleum tenures (ATPs, PLs, PPLs, PFLs) rent is payable in advance by 31 August for the rental year commencing from 1 September.
Rental invoices for the twelve month period (1 September 2009 to 31 August 2010) will be issued in July 2009 with payment due by 31 August 2009.
Rent on exploration permits (EPs) under the Mineral Resources Act 1989 and the Geothermal Exploration Act 2004 is payable on an anniversary basis according to date of grant.
An additional amount of 15% of the rent is payable on most of the above tenures where rent is not paid by the due date. In addition, petroleum tenures attract interest where the rent is paid more than three months after the due date.
Generally, rent continues to be paid on relevant tenures until the date of surrender or termination. Failure to pay rent and penalties on MLs, MCs and MDLs before 1 December may result in cancellation of the mining tenement.
Further details in relation to rental payable and conditions applying to tenures can be obtained from the Geothermal Exploration Act 2004, Mineral Resources Act 1989, the Petroleum and Gas (Production and Safety) Act 2004, and the Petroleum Act 1923.
Part 5, section 7 of the Geothermal Exploration Regulation 2005 contains the current yearly rental rate for Exploration Permits.
Schedule 5 of the Mineral Resources Regulation 2003 contains the current yearly rental rates for EPs, MCs, MDLs and MLs for coal and minerals.
Schedules 9 and 10 of the Petroleum and Gas (Production and Safety) Regulation 2004 contain the current yearly rates for ATPs, PLs and PPLs.
You can download copies of the above Acts and regulations from the Office of the Queensland Parliamentary Counsel website.
