Water monitoring authority (WMA)

An authority to prospect (ATP) or petroleum lease (PL) holder may apply for a WMA over land outside the area of an ATP or PL to comply with, or assess the need to comply with, the make good obligation for the ATP or PL.

The make good obligation is summarised as follows:

If, in exercising their water rights, an ATP or PL holder affects a water bore, the holder must take restoration measures to restore the supply of water to the owner of the bore, or compensate the owner for the bore being unduly affected.

To this end, a WMA allows its holder to carry out any water monitoring activity in the area of the authority.

A WMA may be granted over land that is also in the area of another petroleum authority and for one or more ATPs or PLs held by the applicant.

When granting a WMA, the authority itself will describe the area of the authority, as well as the PL or ATP to which it relates.

A WMA ends when the ATP or PL, to which the WMA relates, are all non-current.
